Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Phiamos (the “Service”), operated by WamvyTech (“we”, “our”, or “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Phiamos imports your chess games from supported platforms, analyzes them, and provides statistics, a “Chess DNA” profile, coaching, opponent scouting, training tools, and reports. Features available to you depend on whether you use the free tier, a Pro subscription, or a one-time Coach Report.

We may add, change, or remove features over time. We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Phiamos. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

You sign in through Google. You are responsible for maintaining the security of your Google account and for all activity that occurs under your Phiamos account. Notify us promptly at info@wamvytech.com if you suspect unauthorized use. You may not share your account or use another person’s account without permission.

Phiamos Pro is offered as a monthly or annual subscription, and Coach Reports are available as one-time purchases. All payments are processed by Stripe; by subscribing, you also agree to Stripe’s terms.

• Paid subscriptions may include a free trial. If you do not cancel before the trial ends, you will be charged the applicable subscription fee.
• Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel.
• You can cancel anytime; cancellation takes effect at the end of the current billing period, and you keep access until then.
• Prices, promotions, and discounts may change. Any change to your recurring price will apply only to future billing periods.

Except where required by law, subscription fees are non-refundable, and cancelling stops future renewals rather than refunding the current period. One-time Coach Reports are digital goods delivered immediately and are non-refundable once generated. If you believe you were charged in error, contact us at info@wamvytech.com and we will review it in good faith.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Access accounts, data, or games that are not yours or not publicly available
• Scrape, crawl, resell, or redistribute the Service or its content, or use it to build a competing product
• Reverse engineer, decompile, or attempt to extract source code, except as permitted by law
• Interfere with, overload, or disrupt the Service or its infrastructure
• Upload malicious code or attempt to gain unauthorized access to any system or account
• Misrepresent your identity or use the Service to harass or harm others

We may suspend or terminate accounts that violate this section or that create risk or legal exposure for us or other users.

Phiamos connects to third-party platforms such as Lichess and Chess.com to retrieve your publicly available games. Your use of those platforms is governed by their own terms, and we are not responsible for their services, availability, or data. The chess games and related data you import remain subject to the rights and terms of the originating platform.

Phiamos uses artificial intelligence to generate coaching, analysis, and recommendations. This content is provided for informational and educational purposes only. It may contain inaccuracies and is not professional, financial, or other regulated advice.

We do not guarantee any particular result, rating improvement, or outcome from using Phiamos. You are responsible for how you use the coaching and analysis we provide.

The Service — including its software, design, text, and branding — is owned by WamvyTech and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.

You retain ownership of your own data. You grant us a license to store, process, and display that data as needed to operate and provide the Service to you (including generating your analysis and coaching).

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any analysis will be accurate or complete.

To the maximum extent permitted by law, WamvyTech and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) fifty U.S. dollars ($50).

You agree to indemnify and hold harmless WamvyTech and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you violate these Terms, create legal or security risk, or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Florida, except where applicable law grants you the right to bring a claim in your local courts.
